Olmstead Decision: Technical Assistance, Training and Resources

 

ILRU Technical Assistance and Resources for Olmstead Implementation (excellent online resource for technical assistance related to all aspects of the Olmstead decision at the Independent Living Research Utilization (ILRU) website for assisting in the implementation of the Olmstead decision through training, technical assistance, and the provision of working with advocates in their states on developing plans for delivering services to people with disabilities.

 

Freedom Clearinghouse (A nationwide network of dedicated advocates. "Our Mission is to use the Olmstead decision to free all law abiding people with disabilities from institutions to live in the community." Website for advocates related to the Olmstead decision and planning process. Contains sections entitled Mission, Stuff  to Know and Stuff to Do.)

 

U.S. Department of Health and Human Services: A Compendium of HHS Technical Assistance Activities Related to the Administration’s Community- Integration Initiative Members of the New Freedom Initiative Workgroup  (Contains sections for MEDICAID TECHNICAL ASSISTANCE ON SYSTEM STRUCTURE AND FINANCING, Family and Informal Caregivers, Employment Supports for People with Disabilities, Performance Management and Quality in Community Settings, Promoting Independence, Responsibility, and Consumer-Driven Services, Developing and Supporting A Quality Long-Term Care Workforce, Ensuring Compliance with Civil Rights, Multi-Faceted Technical Assistance Activities. Overview Summary: "On June 18, 2001, President George W. Bush signed Executive Order No. 13217, “Community-Based Alternatives for Individuals with Disabilities.” The Order calls upon the federal government to assist states and localities to implement swiftly the decision of the United States Supreme Court in Olmstead v. L.C., stating: “The United States is committed to community-based alternatives for individuals with disabilities and recognizes that such services advance the best interest of the United States.” To fulfill the mandate of the President’s Executive Order, the Department of Health and Human Services has established the New Freedom Initiative Workgroup to review efforts that have been already initiated in response to the Olmstead decision, and to recommit and refocus the Administration’s efforts in promoting the full participation of adults with disabilities in community life. As part of this effort, members of the New Freedom Initiative Workgroup felt it would be helpful to compile a compendium of selected projects which are currently operational at the federal level to promote the expansion of long term supports and services in community-based settings.")

National Conference of State Legislatures - THE STATES' RESPONSE TO THE OLMSTEAD DECISION: A WORK IN PROGRESS by Wendy Fox-Grage, Donna Folkemer, Tara Straw, Allison Hansen ("To better understand the effects of the Olmstead ruling, the National Conference of State Legislatures (NCSL) conducted a 50-state survey Results from that first survey provide an overview of the choices states are making as they act on their obligations under the Olmstead decision. National Coalition to Promote Community-Based Care ("The National Coalition has been charged with examining the characteristics and service needs of those individuals with serious mental illnesses, and children with severe emotional disturbances, who are hospitalized or at risk of psychiatric hospitalization; identifying the barriers to serving these individuals in the community; and exploring strategies to ensure their successful transition to community living.
